Lord Winton was taken prisoner in the Battle of Preston, and although he was sentenced to death, he escaped from the Tower to France and died in Rome, December 19, 1749. Cf. DNB.
The outlaw Rob Roy MacGregor was already a legendary, disputed figure by the time Scott wrote - a heroic Scottish Robin Hood to some, an over-glamorised, unprincipled predator to others.
